Judge Nichols denied the motion, finding that Redding did, based on the totality of the circumstance, have reasonable suspicion to detain the car and driver, based on the cracked windshield. This was further supported by the evidence presented.
(The defense) is taking advantage of the fact that the officer that made the stop is dead and can't be here to testify. The only thing Redding did was give his life to keep the citizens of Rocklin safe and it would be so wrong to grant this motion under the circumstances.
He was charged with DUI, driving without a license, having an open container in the car and for providing a false name. We linked him to another case under the name of Carlos Munoz where he was arrested in 2004 for being drunk in public.
