We believe that everyone executing the leasing and financing documents thought they were acting under the authority to execute those documents. We are conducting our own inquiries into whether those parties had the proper authority to take those actions. It is apparent that Mr. Smith did not act unilaterally, but was acting in concert with officials in the county. We are working to resolve this matter right away with all parties, including National City Bank and Butler County.

We are obviously concerned regarding the most recent allegation of a document bearing an invalid signature. We have cooperated fully with the FBI with regard to the alleged forged document and will continue to do so. We do not understand Commissioner Furmon's motivations in calling for an FBI investigation. Based upon what we've looked into thus far, we haven't seen anything that would appear to warrant that type of action or an FBI investigation.

The apparent forged signatures aren't on the primary agreements involved, but we certainly would like to find out the source of forgeries, if there are any.

As far as the forms that do contain my signature, I was only verifying my knowledge of the documents and the funds available to the county, since my office was overseeing the Fiber Optics Project. I was always clear to representatives from Dynus that the Commissioners, and only the Commissioners, may act as contracting agents for Butler County. If my signature was used improperly by outside agents, it is extremely unfortunate... The Commissioners know that in 10 years I have operated a highly professional office with full integrity.
