There's absolutely no reason why the state legislature can't regulate attorneys fees. For one, judges are lawyers too. And surely the notion cannot be that the branch that's most responsive to the public shouldn't take the lead in a matter like this.
One of the things we are arguing is that this law in unconstitutionally vague. It bans burning any combustible substance which could be candles or incense. It's not restricted at all to tobacco.
